    The former Italian trainer of Real Madrid Carlo Ancelotti has been sentenced to one year in prison for a crime against the Public Treasury related to the fiscal year DE 2014, while he has been acquitted of another similar one related to 2015.

    Section 30 of the Provincial Court of Madrid condemns him to the minimum penalty provided for by law for the fraud of 2014 and imposes a fine of 386,361.93 euros and the loss of the possibility of obtaining public aid or subsidies and the right to enjoy the benefits or incentives of tax or Social Security for three years.

    Before the criminal proceedings, Ancelotti consigned 1,400,000 euros to pay his tax debt, the urgency surcharge and interest, so now part of that amount will be returned to him.

    The Prosecutor's Office asked for 4 years in prison for the former Real Madrid coach and current coach of Brazil by accusing him of having defrauded the public treasury 1,062,079 euros in the fiscal years of 2014 (386,361 euros) and 2015 (675,718 euros) during the first stage in which the Italian coached Real Madrid.




    Corporate structure
    The court considers it proven that the coach used a corporate structure domiciled in the Virgin Islands and in London for the agreed collection for his image rights, assigned 50% to Real Madrid, a club that promised to pay him for that concept 1,409,645 euros in the 2013/2014 season and 1,795,575 for each of the following two.

    With regard to the year 2015, the court acquits the accused for not having proven that he lived in Spain for at least the 183 days required by law to be obliged to pay taxes, given that he legally established his residence in London in April of that year, when he was dismissed by Real Madrid, even though he kept a home in the Spanish capital.

    During the trial, held on April 2 and 3 in the Madrid Court, Ancelotti said that he never thought of defrauding the Treasury and that he did what the club and his advisors told him, asked for his acquittal and, in case of being convicted, requested that the mitigating circumstances of compensation for the damage be applied, having paid the debt on December 2021, and undue delay.



    The court agrees to notify the ruling to the Tax Agency to make the corresponding adjustments on the amounts paid by the coach.

    Sources of the technician's defense have indicated to EFE that, in addition to returning a good part of the 1.4 million euros that he entered at the end of 2021 for corresponding to the 2015 financial year, the sentence confirms that that year his tax residence was in London.

    Therefore, he calculates that instead of taxing 49% for his total income (about 18 million euros) he should have done it at 20%, with which the refund of the Treasury could be close to 5 million euros
