Capital Punishment

    Doing Coursework in School about this had me thinking..

    Do you think Capital Punishment should be legalized?

    I Do! For such extreme cases as Murder, if you take someones life away you should have yours taken aswell.

    "Let the punishment fit the crime"

    Now, there's the debate about wrongful execution, I say they should be put on Death Row until they are 100% Certain that it was them who done it and then be executed!

    I mean who would want to go out and murder someone if they know they could be executed?

    What are your thoughts?

    I remember reading Les Miserables and there was a quote in it "Death belongs only to *,what right has man to lay hands on a thing so unknown".Made perfect sense to me

    But you can look at it both ways, if someone murders someone I think he doesn't have the right to even live his life!

    At least when someone is executed they won't come out of Prison and repeat what they did! Prison is too good for some people imo!

    I'm undecided only because some people have been wrongly accused in the past.

    To be honest I think jail is the safe way to go, but yeh jail is too good for some folk

    Does that not make you as bad as the murderer??
    You are also taking away the criminal's chance of repentance..
    It has no place in a civilised society imo..It's immoral in my view.
    And there have been numerous examples of wrongful executions..People with a low mental age also look at Bush's record in Texas. It is vengence and not justice imo.. And leaves no room for rehabilitation..

    I don't think it does, of course your still killing someone, but in many cases the Murderer is killing an innocent person for no reason, but the executioner is killing a murderer who imo doesn't deserve the right to live!

    I don't think someone who will go out and intentionally kill someone is allowed to have the chance to repent!

    Of course that is the problem, wrongful executions, and as I said they should be put on Death Row until they are 100% Certain, that's not always possible but I think it is worth it to execute the ones who are proved to have committed the crime. As we all know, there is cases where the Murderer has been let out of Prison, I think this isn't justice at all! Where someone is given the chance to life live like everyone else after they deliberately took the life of someone. Who's to say that when they are released they won't go and kill another person?

    killing someone really dosn't do it for me.
    for rapests peadofiles etc idealy, you want them to want to be dead, but dont kill them.
    so, i think they should be knee capped and shot in the elbows, put in a jail like in the old days with MEN, not with other such perverts and nonces with out tellies/ps2s/etc etc etc

    And as i said if you are not 100% certain,why are they in prison in the first place?
    Who's to say i won't kill a person or you?You can't deny someone the right to life or repent because he/she might commit another crime in the future.If that's the reason for an execution, that you may be stopping them from doing it again,i think that's fairly ridiculous tbh.No offence meant.
    By the same token who's to say a murderer will not leave prison and save somebody's life?

    Leaving aside my moral objections to it,it is open to human error and prejudice and when a mistake is made with capital punishment,it cannot be rectified.

    That's an interesting debate and I don't think there's one correct solution. Both sides have brought up some good points. Since I have to deal with these matters, I'll tell you my opinion.

    Immanuel Kant was a German philosopher and supported the "eye for an eye" mentality. Generally philosophers supported the death penalty. They just wanted punishment, vengeance.

    I spose the problems are obvious: most of the time you can't say 100% he's done it, he committed the crime.

    Also...

    observations and stats prove the opposite is the case. Death penalties don't scare criminals off.

    On the other hand there are two criminal law theories (supported by riminal law professors) (have no clue what's their names in english...) which want to change someone, rehabilitate the criminal. other observations and stats tell us a different story. rehabilitation doesn't work on felons. Sick murderers will always kill people, pedoes will always attack children etc.

    Aye i've read a bit of Kant Marty,but to be honest i found him to be in the minority of any philosopher i've read.Actually he's the only one i can remember being in favour of it.Even Nietzsche hardly one who could be accused of being a liberal is on record as saying he found it abhorrent.

    There is absolutely no difference to me between your common/everyday murder and the murder that a state carries out in the name of justice

    Aye but didn't the Supreme court come down with a cruel and unusual punishment verdict on it in the 70's until Reagan got in and was able to appoint a couple of right-wing judges to the bench after 2 Democratic appointees died in the same year?..or am i confused

    And there were a few states who placed a moratorium on capital punishment in the last decade...Think Illinois was one and canna mind the others.
    Hasn't acted as much of a deterrent in the States imo Iontach..Do you think it has?

    Been years since I read all the philosophy stuff, but our law professor told us the philosophers were more in favor with it - on the other side old law professors were against it.

    Nietzsche, didn't he say * was dead? * became angry and killed him and said: Look who's laughing now, you are dead man?

    Interesting topic, am not sure myself.
    As its been said, its hard to be 100% and if execute an innocent man( remmeber soemting about a man gettin put in chair and his name cleared years later), its just horrible.
    But the alternate is to put them in jail, where IMo is a much better living palce then where most of them live. I would say jail is better then my house. TVs snooker tables, ps2, and whatever else.
    Many people do horrible crimes, just to be put in jail and have a better living and get food. if it was a bad palce to go and to fear it could help keep the crime level down.

    If the crime is proven beyond any doubt let the * swing. If they r kiddie fiddlers just put them in normal prison with all the rest o the dafties and they wil take care of it.

    I voted undecided, not because I am against the idea of executing someone for their crimes, but because I don't think the capital punishment is dealt out fairly.

    IMO a person who kills more persons, or fiddles with children deserves such a punishment. Yet I see the max punishment you get for something of that sort is 20-25 years in prison. But if you kill an important person, like a minister or summat like that you get the capital in countries where it's legal. Now tell me, is a human life worth more than another?

    If there would be a fair punishment system, based on gravity of the crime, not importance of the person killed, then I'd be all for the Capital Punishment.
