The point that Legia will argue before CAS is that not including their player in the previous round is a purely administrative error, since they had multiple roster spots left. They are not trying to make UEFA agree with fielding suspended players.

I can see why UEFA wouldn't want to go against its own rules before any appeals (that would undermine their own credibility too much). They probably expected either team to appeal before UEFA and CAS, depending on the outcome of their first decision. So they pretty much passed the hot potato to CAS and possibly even a court if Legia take the Sion route.

He was only named in the 23 man squad twice in the three games before the second leg against us so had one match left to serve, he should not have been on the bench. It was a mistake by Legia but this rule is an important one, it's basically bedrock, break it and the rules built on it such as suspensions weaken as a result which hurts the integrity of the competition.

If it goes to CAS it's anyone's guess.

Or as this sports lawyer puts it :

We've been denying it all day but Derk has just admitted it was him that got Legia kicked out.

Does anyone know what would've happened if the first game had ended 3-0 to Legia? Would there have been a replay or extra time?

    I'm not picky.
If you mean by "the right way" as in the administration staff doing their job's properly to make sure the correct players are eligible and LEGAL to play and the team does the job on the pitch, then yes, I agree. However, your club fielded an ineligible player who was supposed to be suspended so your club got punished for it. It's a harsh way to go out, and it's not like the FC Sion incident, but you if don't play by the rules then you can expect to get done for it.

You can play the blame game all you like. UEFA enforced their rules and it's just unfortunate for you (but fortunate for us :bbpd:) that it's resulted in you getting booted out the competition.

I guess your administration staff will check and double check things from now on eh? :smiley-laughing002:

Thanks. Is there precedent for that?

I just find it a bit strange. Hypothetically, you could then have a team winning a first leg 3-0 and then deliberately forfeiting the return tie, knowing that they will go through.

I doubt they will go as far as CAS, they will make an appeal to UEFA, it will get thrown out and that will be that. Doesn't really matter if they do or not though, it has absolutely nothing to do with us.

Unless I've jumped the gun here, i saw posts about him talking out of term again about us..

I've definitely saw 2 of his little outbursts over the last fortnight..

Slating the board over our transfer dealings and where we're heading plus giving our transfer secrets to the media..

    * has been nicking a wage for years, he should shut his mouth again..

But the thing with this though is that ANY club can just come out with the defence of saying "Ach, we didn't know and we made a wee error". If one club does it, then, for me, that sets a precedent for any club to try and get away it with it. I can see what you're saying that they didn't intentionally go out to cheat, but that doesn't matter. Whether it was by mistake or intentional, they * up. The player was suspended and they should have made absolutely sure that he was still not allowed to play.

Bereszynski wasn't registered for the tie against St. Pat's, so the club should have known that those two matches WOULDN'T have counted towards him serving his ban. They registered him for the tie against us, he wasn't in the 18-man team, so that was only one match out of the 3 served. As we know, he played in the 2nd leg, but illegally because he still had two matches to go for his suspension. Bereszynski now has an additional ban on top of the ones he is still to serve, all because Legia * it up.
