Sion claim they were eligible and fifa/uefa are saying the opposite of this, and the winner will be who can prove which case is right.

If sion win though it could set a precedent and this is the problem uefa will want to avoid and thats why i think CAS will approve in favour of uefas decision.

Is the basis of their argument that they're saying the players were signed while the transfer embargo was under appeal and therefore it wasn't being enforced? I remember seeing this argument in the past but recently I hadn't seen any real reasoning behind the whole debacle.

Not a chance the decision is going to be reversed IMO. Game is in 8 days so it would just be beyond ridiculous.

Looked it up again. I'm no legal expert, so please forgive that I was a bit rash in my answer, which was not all correct. The claim is about something like "protection of legal personality". There is apparently a precedence judgement by the Supreme Court (can't find it right now) which says that a footballer has the right to play in order to conserve his value on the market. Apparently the judge in the Sion case refered to this by saying that this rule is valid as long as a case is still pending. So, it's got something to do with work indeed. But don't take this for granted, I'm no lawyer or so, as I said. Too complicated stuff for me, no idea what their claim actually means.

Edit: This concerns the players' appeal only. There is also an appeal filed by the club against UEFA. I don't really know what this is about either. The main argument is still: You are allowed to take a matter to civil court to obtain provisional measures prior to a CAS verdict. As you can read here in the last paragraph: http://www.tas-cas.org/rules

Since when is Switzerland part of the EU? Don't get this really. Any sources?

EDIT: I understand there was a form of miscommunication.

That is true for the players we transfered in summer 2010 when the whole thing was under appeal. These transfers were accepted by all parties and the players have been playing for us since then. It is different however with the players we signed this summer. Here, the argument is that the transfer ban is (supposedly) already over.

The appeal is expected to be "Booted out".

Sick of hearing about this Sion mob. Majority hadn't even heard of them before the draw and now they're just doing my wick in with this retarded Chairman.

Not a chance they're going to be reinstated.

Dunno what my opinion is of this team. They played good football over 2 legs and probably deserved to go through yes but they were a littleanti-football in the leg at Celtic Park and then when we went over there whenever we had possession they hacked us down. Now their Chairman is coming out with promises of being re-instated and saying UEFA are against them. That just sounds dickish. I would have liked to remember them for playing good, tactical football and the club have every right to appeal the decision but the way they have went about this has ruined my opinion of them.

Okay... so, when was the ban originally supposed to be enforced, when was it pushed back due to appeals and when was it enforced after the appeal? You would think that it should be pretty cut-and-dried thing if Sion think they signed their players outside of the ban so where does the confusion come in?

Anyone else hearing all the chatter about the possibility this game might not going ahead?

Sounds like * to me. How can that be fair on Athletico, or the other teams in a group that might be * up.

I really wish we were not involved in all this bad blood between Fifa/Uefa and the Sion chairman.

We're * caught right in the middle. So are Madrid, Udinese and Rennes.

No way are fifa, eufa going to allow them back in this year, if they do then we sue them for whatever gate receipts tv money we could have got, we are in end of. sion may win there appeal on swiss land but we will win ours on scottish land meaning a 4.3ag win for us.

The * presenters (think it was king and guidi) on clyde SSB were saying that as it stands, the game might not even go ahead. Athletico Madrid still don't know who they are playing and, as yet, are not selling any tickets. Sion could get a Swiss court order that Uefa would have to obey as they are based in Switzerland.

Then the people on talksport and on BBC radio Scotland mentioned it might not go ahead.

It sounds like they are guessing outcomes. But with, equally annoying, valid points.

This idea that the players should be allowed to play to maintain their value on the market is riddled with holes. Does that mean that if a club bought a player and didn’t play them then the player could take the club to court? That would be thrown out before the guy could state his name! Furthermore, Sion couldn’t use the workers rights idea as there are in no way prevented from paying their players. While they may succeed in the local court I believe this will simply allow them to play the new players in their domestic league. As this is a European competition a Swiss Civil Court would have no jurisdiction to overturn any decision made by UEFA or CAS. Madrid, Rennes, Udinese and ourselves could all appeal the ruling and sue UEFA for lost revenue. It is in the best interest of UEFA to keep Celtic in the competition and I’m positive we will be going to Madrid next week.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:eek:ffice:eek:ffice" />

When have you ever heard of an appeal where a team has been taken out the competition, replaced with another and all reversed with 11 days before the first fixture!

Rest assured the hoops will be playing in the europa this season!
